Terms of Service

1. Acceptance of terms

By downloading, installing, accessing, or using the Monti Crafts mobile app or website (together, the “Service”), or by ticking the box to accept these terms when you create an account, you agree to be bound by these Terms of Use (“Terms”). If you do not agree, you must not use the Service.

These Terms form a binding legal agreement between you and Monti Crafts (“we”, “us”, “our”) and are governed by the laws of England and Wales.

2. Who can use Monti Crafts

The Service is intended for parents and caregivers aged 18 or over. By creating an account you confirm that you are at least 18 years old and have the legal capacity to enter into these Terms. The app is a tool for adults to support their child’s development; it is not directed at children.

We may refuse, suspend, or withdraw access, or close any account, at our discretion where we reasonably believe these Terms have been breached or where required to protect the Service or other users.

3. Your account

You are responsible for:

• Keeping your login credentials secure and confidential
• All activity that takes place under your account
• Ensuring the information you provide (including your child’s date of birth) is accurate and kept up to date

You must not share, sell, or allow anyone else to use your account. If you suspect unauthorised access, contact us immediately at hello@monticrafts.com.

4. Licence to use the Service

Subject to your compliance with these Terms, we grant you a limited, personal, non-exclusive, non-transferable, non-sublicensable, revocable licence to access and use the Service for your own personal, non-commercial use. We reserve all rights not expressly granted. You must not copy, modify, sell, rent, sublicense, distribute, reverse engineer, or commercially exploit the Service except as expressly permitted or as cannot be excluded by law. This licence ends automatically if you breach these Terms.

5. Free access and premium subscription

• Core daily activities are free to use as they are drip-fed to your child’s stage.
• Premium unlocks the full catalogue instantly, plus full milestone tracking, multiple children, and growth data exports.
• Pricing: £4.99/month or £29.99/year, inclusive of any applicable taxes.
• Subscriptions are billed in advance and renew automatically unless cancelled at least 24 hours before the end of the current billing period. Payment is taken through your Apple ID (App Store), Google Play, or our web payment provider, Stripe.
• You can cancel at any time via your Apple ID settings, Google Play subscriptions, or your web account. Cancellation takes effect at the end of the current period and, except where required by law, we do not refund partial periods.

Refunds for App Store and Google Play purchases must be requested from Apple or Google. For Stripe web subscriptions, contact hello@monticrafts.com. Nothing here affects your statutory rights as a consumer, including any 14-day cancellation right under the Consumer Contracts Regulations 2013 where it applies.

6. Affiliate links

Some activities link to products on Amazon via the Amazon Associates programme. If you buy through one of these links we may receive a small commission at no extra cost to you. Recommendations are made on merit and are not paid placements. Any purchase is a matter between you and the relevant seller.

7. Intellectual property

All content within the Service — including activity descriptions, illustrations, photographs, text, software, design, trade marks, and branding — is owned by or licensed to Monti Crafts and protected by law. You may not use it except under the limited licence above.

You retain ownership of content you submit (such as growth-tracking entries) and grant us a worldwide, royalty-free, non-exclusive licence to host, store, and display it solely to provide the Service to you. If you send us feedback or suggestions, you grant us a perpetual, royalty-free licence to use them for any purpose.

8. Acceptable use

You agree not to:

• Use the Service for any unlawful, harmful, or fraudulent purpose
• Attempt to gain unauthorised access to the Service or its systems
• Scrape, copy, or redistribute our content without our written permission
• Resell, mirror, or make the Service available to any third party
• Impersonate another person or misrepresent your affiliation
• Introduce malicious code or otherwise interfere with the Service’s operation

We may suspend or terminate accounts that breach these Terms.

9. Disclaimer

Activities and information are for general informational and inspirational purposes only and are not a substitute for professional medical, developmental, or paediatric advice. Always consult a qualified health professional if you have concerns about your child’s development. We make no guarantees about developmental outcomes — every child develops at their own pace.

To the fullest extent permitted by law, the Service is provided “as is” and “as available” without warranties of any kind. You are responsible for supervising your child and for ensuring any activity or product is safe and suitable before undertaking it.

10. Limitation of liability

To the fullest extent permitted by law, we are not liable for any indirect, incidental, special, consequential, or punitive damages, or for loss of profits, revenue, data, or goodwill. Our total aggregate liability for all claims relating to the Service or these Terms shall not exceed the greater of (a) the amount you paid us in the 12 months before the claim, or (b) £50.

Nothing in these Terms excludes or limits our liability for death or personal injury caused by our negligence, for fraud, or for any other liability that cannot be excluded under the law of England and Wales. Nothing here affects your non-excludable statutory rights as a consumer.

11. Indemnity

To the extent permitted by law, you agree to indemnify and hold harmless Monti Crafts and its officers, employees, and contractors from claims, liabilities, damages, and reasonable costs (including legal fees) arising out of your breach of these Terms, your misuse of the Service, or content you submit — except to the extent any claim arises from our own negligence or breach.

12. Third-party platforms

The Service relies on third parties including Apple, Google, Stripe, and Amazon, whose own terms apply to their services. Where you obtain the app from the Apple App Store, you acknowledge that these Terms are between you and Monti Crafts only (not Apple); that Apple has no obligation to provide support or warranties for the app; that Apple is not responsible for claims relating to the app, including product-liability or intellectual-property claims; that you are not located in an embargoed country or on a US restricted-parties list; and that Apple and its subsidiaries are third-party beneficiaries of these Terms.

13. Changes to the Service

We may update, modify, suspend, or discontinue all or part of the Service at any time. Where a material change adversely affects your paid subscription, we will give reasonable notice and, where appropriate, the option to cancel without penalty.

14. Changes to these terms

We may revise these Terms from time to time. If we make material changes we will notify you via the app or email before they take effect. Continued use after the effective date constitutes acceptance of the revised Terms.

15. Suspension and termination

You may close your account at any time. We may suspend or terminate your access immediately if you breach these Terms, if required by law, or to protect the Service or other users. On termination, your licence ends and you must stop using the Service. Provisions that by their nature should survive termination will continue to apply.

16. General

• Governing law: the laws of England and Wales apply and its courts have exclusive jurisdiction, except that consumers resident elsewhere may benefit from mandatory local protections.
• Severability: if any provision is unenforceable, the rest continue to apply.
• No waiver: not enforcing a provision does not waive our right to do so later.
• Assignment: you may not assign these Terms without our consent; we may assign them to a successor or affiliate.
• Entire agreement: these Terms and our Privacy Policy are the entire agreement between you and us regarding the Service.
